.EU Registration Agreement
This registration agreement exists between you as an applicant for an .EU
domain name (in the following referred to as you, your) and the provider,
emerion WebHosting GmbH of the services for application (referred to as we, us, our) in
addition to our existing terms and conditions.
- Pre-Registration
Before the beginning of public registration (following the first come,
first serve concept) no real-time registration of a domain name is possible.
The phase before public registration is called pre-registration and divided
into three periods:
- Sunrise 1: from December 7, 2005 to February 6, 2006
- Sunrise 2: from February 7, 2006 to April 6, 2006
- Landrush: starting at April 7, 2006
In this phase it is possible to apply for an .EU domain name.
If the application is accepted by the registry the domain name will be
registered. Application and revision have to be paid as stated in Chapter 7
.
- Applicant and Registrant
During the time of pre-registration you are the applicant. In case of
registration of your domain (please see chapter 5 concerning registration)
you become the registrant of the selected domain name.
Registering .EU domain names is only possible for persons who can prove
that they have a residence in a country belonging to the Eurpean Union.
According to that companies and organizations need to have their central
administration or principal place of business within a country belonging
to the European Union.
- Application and Registering
During the phase of pre-registration „register“ means to apply for an .EU
domain name. Application itself is not to be considered as a right to become
the owner of the domain name mentioned in the appliction.
- Validation of Prior Rights
During the Sunrise Periods it is only possible to apply for domain names
for which the applicant owns a trade mark ore the applicant has any other kinds
of prior rights.
- Validation Agent
For validation of prior rights the registry appoints PricewaterhouseCoopers
as its validation agent.
- Documentary Evidence
The registry will contact you via email (the email address specified by
you in your application) and provide you with information on how to send the
documents proving your rights. There is a 40 days time frame, starting
at the day when the application was received by the registry, to submit
your documents to the validation agent.
- Responsibility of the Document Providing Party
You as an applicant are the party providing the necessary documents and
therefore you are responsible for their correct and complete transmisson.
- Registration of a Domain Name
We cannot give any warranty on registration of an .EU domain name.
The decision which domain names may be registered for whom will only be made
by the Validation Agent and the Registry.
- Application Cost
The price for an application will be charged. The price differs depending on
the selected pre-registration period and is shown in the shopping cart during
online ordering and in the following confirmation e-mail.
These are one-time fees for application which are not a credit for the annual
domain fee in case the domain name may be registered for you.
- Payment Conditions
An application for an .EU domain name will only be submitted to the Registry
after we received the payment from you. If you do not pay within 40 days we cancel
your application and the invoice.
The annual domain name fee is charged only after your selected domain name has
been registered for you.
- Refund of .EU Domain Name Application Fees
If an application is processed by the registry and the validation agent but
the domain name is not registered for you, the application fee is not refundable.
If your application is not reviewed by the registry the application
fee will be refunded partially according to the pricing published on our website.
Additionally you shall agree that refunds are kept as credit at your
emerion WebHosting GmbH account and are not paid back.
